2. Overview

We process personal data only to the extent necessary to provide this website, to sell and deliver our digital products and to answer your requests. The legal bases are Art. 6(1)(b) GDPR (contract and pre-contractual requests), Art. 6(1)(c) GDPR (legal obligations, e.g. tax retention), Art. 6(1)(f) GDPR (legitimate interests, e.g. secure and stable operation of the website) and, where we ask for it, Art. 6(1)(a) GDPR (consent).

3. Hosting and website provider

This website and our shop are operated on the platform of Wix.com Ltd., 40 Namal Tel Aviv St., Tel Aviv, Israel. When you visit the website, Wix processes technical data such as IP address, browser type, device information, pages visited and time of access in order to deliver the website securely. The European Commission has issued an adequacy decision for Israel. Insofar as Wix uses service providers in other countries, transfers are based on the safeguards provided by Wix. Legal basis: Art. 6(1)(f) GDPR.

4. Cookies and statistics

Wix sets cookies that are technically necessary for the website and the checkout to work (Art. 6(1)(f) GDPR, § 25(2) TDDDG). We also use the statistics function of Wix to understand in aggregate how the website is used, for example which pages are visited. We do not use any other tracking or advertising tools.

5. Orders and delivery of digital products

When you place an order, we process your email address, first and last name, the products ordered, your billing information as far as required, and your confirmation of the right of withdrawal checkbox. We use this data to conclude and perform the contract and to deliver the digital content via the download link on the confirmation page (Art. 6(1)(b) GDPR). We retain order and billing data for the statutory retention periods under commercial and tax law (Art. 6(1)(c) GDPR).

6. Payment

Payments are processed by the payment service provider integrated into our Wix shop and, if you choose them, by Apple (Apple Pay) or Google (Google Pay). Your payment data is transmitted directly to these providers; we do not receive your full card details. Legal basis: Art. 6(1)(b) GDPR. The respective privacy policies of these providers apply.

7. Contact by email

If you contact us by email, we process your email address and the content of your message to answer your request (Art. 6(1)(b) or (f) GDPR). We delete the data when it is no longer needed, unless statutory retention obligations apply.

8. Instagram and automated direct messages

We maintain an Instagram account. Instagram is operated by Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland. For the processing of statistics about our Instagram account we are jointly responsible with Meta (Art. 26 GDPR); Meta's privacy policy applies.

If you comment on one of our posts with a keyword (for example "SLEEP" or "TONIGHT"), you automatically receive a direct message with the requested free content. For this we use the service Zorcha (zorcha.com), which is based in India. Zorcha processes your Instagram username, your comment and the messages exchanged. Legal basis: Art. 6(1)(b) GDPR (your request). India is a country outside the EU without an adequacy decision; the transfer takes place on the basis of the safeguards agreed with the provider. If you do not want this, please do not comment with the keyword.

9. Your rights

You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You can withdraw consent at any time with effect for the future. To exercise your rights, contact kontakt@switchoffatnight.com. You also have the right to lodge a complaint with a supervisory authority, for example the Bavarian State Office for Data Protection Supervision (BayLDA), Promenade 18, 91522 Ansbach, Germany.

10. Automated decision-making

We do not use automated decision-making or profiling within the meaning of Art. 22 GDPR.
