1. Provider and scope

These Terms of Service apply to all contracts for digital products concluded through switchoffatnight.com between Şükrü Alibaba (full contact details see Imprint) ("we", "us") and you as our customer. "Switching Off at Night" is our brand. "Luna" is a fictional brand persona and not a real individual; all contracts are concluded with the provider named above. Contact: kontakt@switchoffatnight.com. Terms of the customer that deviate from these Terms do not apply unless we expressly agree to them.

2. Products

We sell digital products, in particular PDF guides, audio files and bundles of these. All products are delivered digitally. No physical goods are shipped. The product description on the product page applies.

3. Conclusion of contract

The presentation of products in our shop is not a binding offer. By clicking the order button at the end of the checkout you submit a binding offer to buy the selected products. The contract is concluded when we accept your order by making the digital content available after successful payment. The contract language is English. We store the order data. You can view these Terms at any time at switchoffatnight.com/agb.

4. Prices and payment

All prices are final prices in euros. There are no shipping costs. You can pay by credit card, Apple Pay or Google Pay. Payment is due when you place the order. Payments are processed by an external payment service provider.

5. Delivery of digital content

After successful payment you receive access to the digital content immediately, via a download link that is shown on the confirmation page directly after your purchase. The link is displayed only on this page and is not sent by email, so please download your files right away and save them. The content can be opened with standard software on common devices (PDF reader, audio player, ZIP extraction); no special app is required. If you have trouble accessing or opening a file, please contact us at kontakt@switchoffatnight.com and we will provide it again.

6. Licence and permitted use

Upon purchase you receive a personal, non-transferable, non-exclusive licence to use the content for your own private use. You may not share, resell, distribute or publicly post the content, reproduce it for commercial purposes, or present it as your own. All rights to the content remain with us.

7. Right of withdrawal

If you are a consumer, you have a statutory right of withdrawal, described in our Right of Withdrawal Policy below. For digital content that is not supplied on a physical medium, the right of withdrawal expires once we have begun to perform the contract after you have expressly agreed that we begin before the withdrawal period ends and have confirmed that you thereby lose your right of withdrawal. You give this agreement and confirmation by ticking the required box in the checkout.

You expressly agreed that we begin delivering the digital content before the 14-day withdrawal period ends, and you confirmed that you thereby lose your right of withdrawal as soon as delivery has begun.

8. Defects

The statutory rights regarding defects of digital products apply. If a file is damaged, incomplete or cannot be opened, please contact us at kontakt@switchoffatnight.com. We will provide a working version. Your statutory rights remain unaffected.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. In cases of slight negligence we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you can regularly rely), and then only for the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded. These limitations also apply to our legal representatives and vicarious agents.

10. Educational purpose, no professional advice

Our products are for general educational and informational purposes only. They are not medical, psychological or therapeutic advice, diagnosis or treatment and do not replace professional help. If you are in a mental health crisis, please contact a licensed professional or the emergency services in your area.

11. Data protection

We process personal data as described in our Privacy Policy.

12. Final provisions

The version of these Terms in force when you place your order applies to that order. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected. If you are a merchant, the place of jurisdiction is Munich. If a provision of these Terms is invalid, the remaining provisions stay in force.

RIGHT OF WITHDRAWAL POLICY

Right of withdrawal

If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the contract was concluded.

To exercise your right of withdrawal, you must inform us (Şükrü Alibaba, Geiselgasteigstraße 48, 81545 München, Germany, email: kontakt@switchoffatnight.com) of your decision to withdraw from this contract by an unequivocal statement, for example by letter or email. You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event within 14 days from the day on which we receive your notice of withdrawal. We will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

Expiry of the right of withdrawal for digital content

The right of withdrawal expires for a contract for the supply of digital content not supplied on a physical medium if we have begun performance after you (1) expressly agreed that we begin performance before the withdrawal period ends and (2) confirmed that you thereby lose your right of withdrawal as soon as we begin performance. You give this agreement and confirmation by ticking the required box in the checkout.
